3 – Acceptance of General Terms of Use

The continued use of the Site shall constitute the full acceptance of the General Terms of Use contained herein.

Echo Studio reserves the right, at any time, to alter, complete, delete or otherwise add, without notice, in whole or in part, the present General Terms of Use of the Site to adapt the development of services and the legislation in force.

These changes are brought to the users’ attention simply by being posted online. Henceforth, they are deemed accepted without reservation by any user accessing the Site after their posting. Consequently, the user is invited to consult this disclaimer at each visit on the Site to take note of its latest version.

4 – Third-Parties Identifiers

Access to certain functionalities or services may require the use of identifiers from third-party services such as Facebook, Twitter, LinkedIn.

The user will be required to connect with his/her own identifiers to access all functionalities involving interaction with such third-party services.

The creation and use of such accounts and the personal data provided by the user to such third-party services are subject to the Terms of Use and Privacy Policy of each third-party services, excluding Echo Studio from any liability.

The Site and all the content it contains, or may in the future contain, either independently or together, including but not limited to the programs, specific developments and the contents including but not limited to data, texts, still or moving images, logos, audio materials, graphics, document or data files, are the exclusive property of Echo Studio or the third parties who have granted a license to Echo Studio.

Any representation in full or in part of this Site or any of its components without Echo Studio’s express permission is prohibited and shall constitute an infringement sanctioned by Articles L. 335-2 et seq. of the French Intellectual Property Code.

  • Trademarks and Other Distinctive Signs

The trademarks and logos appearing on this Site are the properties of Echo Studio or third parties. Any reproduction, imitation or use, in whole or in part, of these distinctive signs without express prior permission and in violation of the prohibitions laid down in Articles L. 713-2 and seq. of the French Intellectual Property Code shall render the perpetrator liable.

Other distinctive brand features, in particular trade names, commercial names, signboards, domain names reproduced on the Site are the property of Echo Studio or third parties and any reproduction without express prior permission shall constitute a usurpation which the perpetrator shall be held liable pursuant to Article 1382 of the French Civil Code.

6 – Liability

Echo Studio undertakes to make its best efforts to ensure access to the Site at all times, but cannot be held liable in any way in the event of the Site being unavailable for any reason whatsoever.

Although Echo Studio makes every effort to ensure that the content of its Site is reliable (subject to any changes that may have been introduced since it was put online), it does not guarantee that the information provided on the Site is free from errors and omissions or up to date, whether of its own doing or that of third-party partners providing the concerned information. Consequently, the use of this information is the user’s responsibility alone.

  • Damages

Echo Studio shall not be liable for any direct or indirect damages caused to the equipment of the user by reaching the Site, and resulting either from the use of obsolete hardware or from the appearance of a bug or incompatibility.

7 – Confidentiality of Personal Data

Echo Studio invites the user of the Site to consult its Personal Data Protection and Privacy Policy accessible below. 

8 – Cookie Policy

The user is informed that during his/her visits to the Site, one or more cookies may be automatically installed on his/her computer through his/her browser software. A cookie is a small computer file, a tracer, as means of analyzing the user’s behavior when visiting a website, reading an e-mail, installing or using a software or a mobile application. A cookie does not identify the users, but records information about their navigation on the Site.

When using the Site, cookies may be installed by Echo Studio and by social networks.

The cookies installed by Echo Studio when visiting the Site are only session cookies. Echo Studio uses this information to improve its services, and to adjust the content and presentation of the Site based on the user’s browser type or other information sent by the browser.

Some pages of the Site offer sharing buttons that allow users to take advantage of social networking features and, in particular, to share content present on the Site with other users of such networks. When the user visits a web page on which appears one of these buttons, the user’s browser can send information to the social network, which can then associate the visit to the page with the user’s profile on the said social network. The cookies thus installed allow the user to interact from the Site on social networks. If the user does not want the social network to link the information collected through the Site to his/her user account, the user shall log out of the social network before visiting the Site.

Echo Studio informs its users that it has no control over cookies installed in the user’s browser by social networks.

A cookie, whether installed by Echo Studio or by social networks, remains a maximum of 13 (thirteen) months from the day on which the user of the Site has given his consent to the installation of the said cookie.

The user may configure his/her computer’s browser to refuse the installation of cookies, bearing in mind that refusing to install a cookie can make it impossible to access certain services. Echo Studio declines all responsibility regarding the consequences of the Site’s degraded operation resulting from the refusal or deletion of cookies by the user of the Site necessary for the Site’s operation.

9 – Final Provisions

The present General Terms of Use shall be subject to and construed according to French law. Any dispute relating to the interpretation, application or fulfilment of these General Terms of Use will be subject to the exclusive jurisdiction of the Courts of Paris (France).

If any part of the present General Terms of Use should prove to be illegal, invalid or inapplicable for whatever reason, the term or terms in question will be declared non-existent and the remaining terms will retain all their force and their scope and continue to be applicable.

The non-application or absence of any claim for the application by Echo Studio of any of the provisions of these General Terms of Use shall, in no way, be interpreted as a waiver by Echo Studio of such a provision or such a right, unless Echo Studio stipulates otherwise in writing.


PROTECTION OF PERSONAL DATA AND PRIVACY POLICY

Echo Studio undertakes, within the framework of its activities and in accordance with the regulations applicable in France and in Europe, and in particular the European Regulation on the Protection of Personal Data, to ensure the protection, privacy and security of personal information of the users of the Site and its commercial partners, and to respect their privacy.

2 – Which Personal Data Are Collected? 

Your personal data collected and processed are your name, surname, first name, title, business or personal e-mail address, business postal address, business telephone number, information relating to your professional experience, your history of business relationship with Echo Studio.

When using the Site the user is not required to provide Echo Studio with any personal data. Notwithstanding the foregoing, to use specific services provided on the Site, including the online newsletter registration form, the user of the Site may be required to provide Echo Studio with specific information such as first name and email address. The user may refuse to provide such personal data in which case he/she will not be able to use these services.

3 – How Do We Collect Personal Data?

Your personal data is collected based on your consent, our history of business relationship, your response to the newsletter registration form available on the Site, or when necessary for the provision of services (execution of a contract, invoicing, etc.).

4 – Why Do We Collect Personal Data?

Your personal data is collected to:

  • Manage and optimize customer relations (in particular the execution of a contract, and invoicing);
  • Provide for our B2B commercial prospecting;
  • Share our news and events (newsletters, alerts, invitations and other publications);

If necessary, this personal data shall also be shared with the competent authorities or jurisdictions, in particular to meet our legal and regulatory obligations. In this case, we shall take all useful measures to notify you beforehand, unless the regulations prohibit us from doing so.

7 – Transfer Outside the European Union of Your Personal data

No transfer of personal data to a State outside the European Union shall be made by Echo Studio. 

8 – Safety of Your Personal Data

Echo Studio shall implement the appropriate organizational, technical and software measures regarding physical and IT security to protect your personal data from loss, misuse and unauthorized access, disclosure, alteration or destruction.

9 – Storage of Your Personal Data

Personal data collected and processed by Echo Studio as part of its commercial relations is kept for the period of time strictly necessary to achieve the purpose for which it was collected. Regarding the data relating to the performance of legal services in particular, the data is retained during the contractual relationship between the firm and the client and, beyond that, the data is securely archived for 5 (five) years, before being deleted or de-identified, unless a longer limitation period applies.

Personal data used to send communications about Echo Studio’s offers, news and events shall be stored for a period of three (3) years from the time of collection or your last contact with Echo Studio. At the end of this period, Echo Studio may contact you again to determine whether you wish to continue to receive communications from us regarding offers, news and events. Your personal data will be destroyed as soon as possible after your request to unsubscribe.

10 – What Are Your Rights?

Users whose personal data is collected and processed as part of Echo Studio’s activities are informed that, under the conditions provided by the law, they have the right to access, change, correct, delete and portability of their personal data, as well as the right to limit and oppose the processing of such personal data.
